How to write a purchase agreement

TLDR: Divvy will fill the purchase agreement and send to you for the final edits. As the fiduciary, you will own the contract documents and will send the contract to the listing agent. If this is your first offer, please find your state below and send us your relevant contact information to offers@divvyhomes.com.

 

Note: if your market is in Colorado or Cleveland, Ohio; you will draft the purchase agreement.

 

Finally, a few helpful things to keep in mind...

  1. Divvy is now your client; Divvy Homes Warehouse A, LLC will be the home's buyer
  2. All documents require the signature of an authorized Divvy team member, NOT the tenant's (i.e. your client)
  3. Please do not sign anything on Divvy's behalf
  4. Any seller communications (counteroffers, responses to Divvy requests, etc.) must be communicated in full to a Divvy team member

State-by-state instructions below:

Arizona:

  1. Initiate an offer

    • Go to your Agent Portal

    • Select your client's name and choose "Initiate Offer"

    • Divvy's Home Buying Team will review the offer and call you -- expect a call from a 1-833 number

  2. Send us your contact info

    • Divvy will start by filling in the purchase agreement and we'll send to you for the final edits. You will still own the docs as our fiduciary and you will send the contract to the listing agent. If this is your first offer, please send us the following information so we can include in the contract:

      1. License #

      2. Agent MLS Code

      3. Brokerage name

      4. Brokerage phone number

      5. Brokerage License #

      6. Firm MLS code

  3. Send the signed purchase agreement to the Seller

    • We typically have offers accepted (or countered/rejected) within 48 hours. We ask that you please email us with an update once per day if things take longer.

Colorado

  1. Initiate an offer

  2. Draft the Purchase Agreement (PA) - draft the PA and send to offers@divvyhomes.com for comment. Major requirements include:

    3. Attach two items to contract

      • Addendum-- Check 'does not' for the Escalation Clause and Appraisal Contingency unless we tell you otherwise

      • Proof of Funds

    4. Inspection / Due Diligence timeframe

      • 7 days

    5. Closing Agent and Title:

      • If property has septic system and/or well water, Seller to complete inspection and provide certification
